ok, I was wrong (hey it happens).
The H.264 download option wasn't part of youtube settings, I just thought it was due to association.
after fiddling around with various plugin settings and youtube setting the download option actually comes from the clicktoflash plugin I'm running.
I have no clue if you use safari, firefox's flashblock doesn't seem to do the same thing (though this may be due to the WebM vs H.264 and not the plugins).
Sorry about he confusion. I found out about clicktoflash and youtube html5 stuff at the same time and cross some mental wires.
