I'm pretty sure (American here, not British), that most of those forts, while abandoned and in disrepair, are nonetheless part of preservation sites and historical trusts. Let's try not to piss-off Her Majesty's Government... Err, more than the average Fen already does anyway.
 

Not as far as I know. In fact I expect Her Majesty's Government would be quite pleased to have them go Unreal Estate, because then it's the Convention's problem if someone rams them with an oil tanker.
