Yep.

Anyone who makes that sort of claim about their product - whether it be a tested medicine, a homeopathic concoction, flat-out snake oil, or walnuts - is subject to having to prove their claims to the FDA. (Or, in Canada, to Health Canada.) This is to protect the consumer from so-called "medicines" that either don't do anything or actually do harm.

Somebody at Diamond's advertising agency was asleep at the switch there...
