You know, it is not often that I agree with left leaning defense lawyers, but this one has the right of things. Antivirus protection is supposed to be there to help provide that (illusion) level of privacy that the judge seems to cast off into nothing, yes a dedicated hacker can find a way into any connected system. This is why the most sensitive information is kept on stand alone setups and moved via writable media. But even then it takes time and is not casually found like the pistol on the bedside table. Should the government be required to get a warrant, absolutely. Even with things so nasty as child porn and terrorism, there is still the need for just cause and due process. Anything else would be tyranny, and not the nation I sword to defend.
