I dont think its that bad, even if it doesnt mesh with its portrayal in cannon its consistent with mythology.
The terms of the deal dont preclude it being a major source of conflict/drama in future parts of the story either.
I think your missing the reason the 9 tails jumped on that condition of Naruto's... simplely put... It pimps slaps the Sharingans mind control Biju powers
in the face. Virtually everything the Sharigan users will tell the Kyubbi to do is going to be ignorable via preexisting contracts. Between that and the exotic foods on request thing, Naruto is giving the Kyubbi the bestest dowry EVER.
