Interesting new look at the process. Points raised:

* The law against IP infringement is in fact a criminal statute, not a civil one

* Congress has therefore violated the constitution by treating it as a civil matter and placing enforcement in the hands of the RIAA

* Further violated the constitution by ordering the Courts to try cases as civil matters rather than criminal

* Further violated the constitution by imposing grossly excessive punitive damages

* Violated the constitutional rights of defendants by stepping outside of due process and lawful search, right to a jury trial and competent defense

I'd say wait for the results of the American election tomorrow. If McCain wins, the RIAA will eventually win for apparently unrelated reasons. If Obama
wins, RIAA may still win, but they'll get pushed back and limited in some way, if they don't lose altogether.

I'd be very surprised if Obama won though. He's got two totally unfair strikes against him, and one he's justifiably earned. That pretty much gives
McCain the win, sadly.

Kind of a side thing, but I'm curious as to what you think those strikes are.

More of a subject for the politics forum though.
