In the extreme case I mention, the other driver is guilty of several things... but you're STILL At Fault, because you failed to maintain sufficient
separation between vehicles.
NYS insurance laws are, in case you haven't guessed, Fuqued Up. Another one states that the primary contractor on a construction site is liable for all
injuries that take place on the site, regardless of the cause. Even if it was an employee who came in drunk, ignored safety regs, etc, etc, etc. It's your
responsibility to make sure that that doesn't happen.
